General terms & conditions of business

​1 Scope

 

These General Terms and Conditions apply to all contracts for the rental of apartments for accommodation concluded between Alp Ami Hospitality GmbH (amii) and third parties (guests), as well as to all other services and deliveries provided by Alp Ami Hospitality GmbH.

 

These terms and conditions apply exclusively.

2 Interpretation

In the following conditions, the following terms are used for convenience:

 

“amii” is the Alp Ami Hospitality GmbH.

The "arrival date" is the day that marks the beginning of the booking period. This is determined by the guest during the booking process.

The "departure date" is the day that marks the end of the booking period. This date is determined by the guest during the booking process.

A "room" refers to a unit of living space that amii rents out. These can be apartments, tiny houses, cabins, etc.

“Check-in” is the provision of the digital registration form.

“Booking ID” is the reservation number (alphanumeric code) with which a booking can be uniquely assigned.

3 Rental agreement

3.1 Conclusion of contract

 

The accommodation contract is concluded when amii confirms the guest’s booking. Acceptance by amii occurs through booking confirmation in text form, but at the latest when the room is made available.

 

amii's offers regarding available rooms are subject to change and non-binding. amii reserves the right to refuse to enter into an accommodation contract at its sole discretion.

3.2 Contracting parties

 

The contractual partners are amii and the guest. If a third party has booked on behalf of the guest, they are jointly and severally liable to amii for all obligations arising from the accommodation contract. The third party then becomes the contractual partner.

 

The use of the rooms for purposes other than pure accommodation is not permitted. Furthermore, the room may only be used by the number of guests stipulated in the contract. If additional persons not contractually agreed to stay in the room, this constitutes a breach of duty on the part of the guest.

 

Subletting, re-letting, and/or re-brokering of booked rooms is prohibited. In particular, re-brokering rooms and/or room contingents to third parties at prices higher than the actual room rates is prohibited. The assignment or sale of the claim against amii is also prohibited. In these cases, amii is entitled to cancel the booking, particularly if the guest provided false information regarding the type of booking or payment to the third party during the assignment/sale.

 

3.3 Limitation period

 

All claims against amii generally expire one year from the start of the statutory limitation period. This does not apply to claims for damages or other claims, provided the latter are based on an intentional or grossly negligent breach of duty by amii.

 

4 Performance & Payment

4.1 Services

 

amii is obliged to keep the rooms booked by the guest or equivalent alternatives available and to provide the agreed services.

 

The guest is obligated to pay the applicable or agreed prices of amii for the provision of the room and any other services used by the guest.

4.2 Prices

 

The prices quoted by amii at the time of contract conclusion apply. The applicable prices are gross total prices and include all statutory taxes, fees, and charges. Local charges that are payable by the guest under the respective municipal law, such as tourist tax (accommodation tax), may not be included and may be charged separately.

 

Should the VAT rate applicable to the contractual services increase or decrease after the conclusion of the contract, the prices will be adjusted accordingly.

 

If the period between conclusion of the contract and fulfillment of the contract exceeds six months and the price generally charged by amii for such services increases, amii shall be entitled to adjust the contractually agreed price appropriately, but not by more than 15%.

 

amii may also change prices if the guest subsequently requests changes to the number of rooms booked, the services provided by amii, or the length of stay, and amii agrees to these changes. Changes must be made in writing.

 

If the guest has the opportunity to specify non-contractual special requests during the booking process, these are always non-binding. The guest has no right to expect the room to accommodate these non-contractual special requests unless amii has expressly confirmed them in writing.

 

4.3 Payment

 

Payment using the deposited payment method is always made in advance during the booking process. The arrival time is 2:00 p.m. on the booked arrival date. amii is entitled to demand payment of outstanding amounts at any time. In the event of late payment, amii is entitled to demand the applicable statutory default interest within the meaning of Section 288 of the German Civil Code (BGB). amii expressly reserves the right to claim further damages.

Valid payment methods are MasterCard, Visa Card, PayPal and Sofortüberweisung (SOFORT)

 

For each reminder sent after the due date, a reminder fee of €10.00 will be charged. The guest is free to provide evidence that these fees were not incurred or were not incurred to the required amount.

 

4.4 Security

 

amii is entitled to request an appropriate advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment or security deposit and the payment dates can be agreed upon in writing in the contract. In this case, amii is entitled to satisfy itself from the security deposit in the event of non-compliance with the payment deadlines, e.g., by collecting the agreed payment by credit card.

 

The guest may only offset undisputed or legally established claims against amii.

5 Customer data

 

To ensure communication with the guest, amii requires the email address, telephone number, and the correct first and last name of the primary guest. To verify the guest's identity, amii is entitled to request a valid identification document (an ID card or passport for domestic guests; a passport for international guests) and valid credit card details upon check-in.

 

If the identity of a guest cannot be clearly established due to missing or incorrect documents, amii is entitled to cancel the booking.

 

Furthermore, the guest authorizes amii to send messages about their booking via their preferred channel. This includes communication channels such as WhatsApp, SMS, etc.

 

Should a new pandemic occur, amii is permitted to comply with the current pandemic guidelines at the location of service provision. To comply with this regulation, amii is entitled to request proof from the guest. This can be proof of vaccination, a negative test result, or a certificate of recovery. However, the permitted proof depends on the guidelines, which were not initiated by amii.

 

6 House rules

 

The house rules include the following provisions:

A detailed description of the house rules, including any applicable fees in the event of a violation, is provided below.

A breach of the house rules constitutes a violation of contractual obligations.

 

House Rules: 

 

Smoke

Smoking is not permitted in our rooms or common areas. E-cigarettes and smoking near open windows are also prohibited. Smoking is only permitted in outdoor areas.

Failure to comply with the rules will result in a penalty fee of €150.00 plus any applicable fees for removing the pollution and/or odor.

 

Pets

Dogs are allowed with prior notice.

We charge a fee of €30.00 per dog per night. No other pets are allowed.


 

Parties oder Events

amii loves to party just as much as you do, but perhaps not all of the guests staying with us during your stay. Therefore, parties and events of any kind are not permitted.

Failure to comply with the rules will result in a penalty fee of up to €500.00 plus any applicable fees for the removal of pollution and/or damage.


 

Excessive pollution

Yes, we want you to feel at home. However, please make sure you leave our rooms in a tidy condition. Our cleaning staff doesn't want any unpleasant surprises either.

Soiling that requires additional cleaning may be subject to a penalty fee of up to €500.00.

 

Accommodation of non-booked persons

A specific number of guests is always included in your booking. Children up to and including 12 years stay free of charge. From the age of 13, an additional fee of €20.00 per person per night applies.

If you have visitors and allow them to stay overnight without prior notice, the same fee of €20.00 per person per night will apply.

 

Booking for minors

You must always be at least 18 years old to book with amii. If you are younger, we require written permission from a parent.

 

Excessive volume

You're not our only guest. Of course, you're welcome to watch TV and listen to music, but at a reasonable volume that doesn't disturb other guests.

 

Illegal substances

amii trusts you; illegal substances are strictly prohibited at our locations. Failure to comply would result in a lifetime ban.

 

Adjustments in the room

Any changes to the interior (moving furniture, etc.) are not permitted.

 

Commercial photography, film or videography

Please use our rooms for the purpose for which they were designed.

 

Use for other purposes

Pornographic production or prostitution is strictly prohibited and will be prosecuted. Violations will result in directClaim our house rules.

 

Theft

This really doesn't need any explanation. You don't want things stolen from you either. In case of non-compliance, we will charge you the full purchase price of the item plus a penalty fee of up to €100.00.

 

Damage

You must notify us of any damage immediately. Even if you consider the damage to be minor, a brief notification is appreciated. Failure to do so may result in us charging you for the damage.

 

Communication

You may encounter amii service providers on site. However, please direct any inquiries you may have to us directly. We offer several options for this.

 

Check-in & Check-out

According to our policy, your room will be available from 2 p.m. on the day of arrival. 

 

Check-in from 2 p.m.: free

Early Check-in from 1 p.m.: € 25

Early Check-in from 12 noon:  € 50

 

On the day of departure, you must vacate the room by 10 a.m. at the latest. The following charges apply because there is no housekeeping on-site after 2 p.m., and the room cannot be cleaned. So just let us know if you need to check out later.

 

Check-out until 11 a.m.: free

Check-out after 11 a.m. until 12 noon: € 25

Check-out after 12 noon until 2 p.m.: € 50

 

7 Provision & Return

7.1 Provision

 

The guest does not acquire any right to the provision of specific rooms.

 

Booked rooms are available to guests from 2:00 p.m. on the agreed arrival day.

7.2 Return

 

On the agreed departure date, the room must be vacated and made available to amii by 10:00 a.m. at the latest. For any unauthorized or agreed-upon use beyond this time, amii may claim compensation (the price of the following night for the same room type at the time of the breach) as follows:

 

Check-out until 12 noon: 25% of the price of the following night

Check-out until 2 p.m.: 50% of the price of the following night

Check-out until 4 pm: 75% of the price of the following night

Check-out until 6 pm: 100% of the price of the following night

 

The room must be returned in the same condition as it was found. Guests must remove all personal belongings from the room and dispose of any food and excess trash. In the event of a violation, amii reserves the right to charge the guest an increased cleaning fee based on the amount of damage plus any processing costs.

 

amii rooms may be booked for a maximum of 182 consecutive days.


If the Bathroom amenities from Treks are to be purchased, amii will be happy to provide the contact details of the retailer to the guest so that they can order them directly there.

If entire bottles have been removed from the bathroom without amii's consent, amii reserves the right to charge an additional €30 fee and debit this fee from the guest's payment method.


 

8 Resignation

8.1 Cancellation by guest

 

A binding booking is made once the guest's payment has been received. A binding booking can be canceled by the guest in accordance with the stated cancellation policy, providing the booking ID. After the cancellation deadline has expired, cancellation is excluded, and amii retains the right to the agreed fee less any savings. The same applies in the event of a no-show. For guaranteed multi-day bookings, all subsequent nights from the second night onwards will be canceled in the event of a no-show, and the guest is no longer entitled to any subsequent nights.

 

Bookings for which payment has not yet been made by the guest are valid until 11:00 AM on the day of arrival. After 11:00 AM, the reservation expires automatically and free of charge. amii reserves the right to rent the booked room to someone else.

The cancellation policy below applies to guests. These may vary from location to location.

 

Cancellation policy

Cancellation up to 21 days before arrival: Free of charge

Cancellation 20 to 15 days before arrival: 40% of the total booking amount will be charged

Cancellation 14 to 8 days before arrival: 60% of the total booking amount will be charged

Cancellation 7 days or less before arrival or no-show: 100% of the total booking amount will be charged
It is then up to amii to initiate a partial refund as a gesture of goodwill.

The arrival time is 2:00 PM on the booked arrival date. In the event of early departure after check-in, a refund of the agreed price for all subsequent services booked is excluded.

 

If a right of withdrawal has already expired, there is no statutory right of withdrawal or termination, and amii does not agree to a cancellation of the contract, amii reserves the right to claim the agreed remuneration despite the guest not using the service. For unused rooms that amii was able to rent to someone else, the guest will be credited with the income from the alternative rental as well as the saved expenses.

8.2 Withdrawal by amii

 

If an agreed or requested advance payment or security deposit is not made even after the expiry of a reasonable grace period set by amii, amii shall be entitled to withdraw from the contract.

 

amii is also entitled to withdraw from the contract for objectively justified reasons, for example if

 

(a) force majeure or other circumstances beyond amii’s control make the performance of the contract impossible;

(b) the room is booked under misleading or false information regarding facts essential to the contract, for example those relating to the person of the guest or the purpose of the booking;

(c) the booked rooms are occupied by a guest other than that specified in the booking process without prior notice to amii

(d) amii has reasonable grounds to believe that the use of the booked rooms may endanger the peace, security or public reputation of amii, without this being attributable to amii's sphere of control or organization.

 

amii must immediately notify the guest in writing of the exercise of the right of withdrawal/termination.

 

In the event of a justified cancellation by amii, the guest shall not be entitled to compensation.

 

9 Technical setup and internet usage

 

The use of guests' own electrical devices using the room's power supply is at their own risk. Any malfunctions or damage to the room's technical systems caused by the use of these devices will be the guest's responsibility, unless amii is responsible for them.

 

The guest is prohibited from engaging in illegal file sharing via the internet connection provided by amii. This includes any upload or download of copyrighted data in any form. The guest is liable for all damages incurred by amii and/or the rights holder as a result of the guest's infringement.

 

Guests are prohibited from sharing their internet access credentials with third parties. In the event of a violation, the guest is liable to amii for any damages resulting from the sharing of their access credentials.

Furthermore, amii reserves the right to block the guest’s internet connection in the event of legal violations.

 

10 Access to the rooms

 

amii is entitled to enter the rented room for cleaning and linen changes, as well as, after consultation with the guest, to carry out repairs, read electricity and water meters, and inspect the property for possible subsequent rentals. In case of imminent danger, amii is also entitled to enter the room without prior consultation with the guest.

 

11 Maintenance and liability of the guest

 

The guest is obligated to treat the room and its furnishings, as well as the communal facilities, with care and attention, to prevent damage, and to ensure the necessary ventilation and heating. In particular, the guest must avoid excessive soiling, dispose of waste regularly and properly, and maintain a minimum level of order so that the agreed cleaning services can be carried out without further ado and the room can be kept in a clean and hygienic condition through the standard cleaning measures carried out within this framework. amii is entitled to charge the guest for increased cleaning costs due to excessive soiling or disorder. If the guest fails to comply with their aforementioned obligations even after a written warning, amii is entitled to terminate the accommodation contract without notice.

 

The guest is liable for all damage to the building or inventory caused by visitors, employees, or other third parties from their area, or by the guest themselves. Furthermore, the guest is liable for all other damages and expenses incurred by amii due to improper use of the rental property or items brought into the property. This also includes costs incurred by amii due to the negligent activation of fire alarm systems (smoke detectors) (in particular, costs for a fee-based fire service call).

 

amii reserves the right to use the provided payment method to cover the costs of repairing any damage to the room or its contents caused by the guest or any fellow travelers or visitors. amii will first determine the cost of repairing the damage by obtaining a cost estimate from a professional tradesman.

 

The guest is obliged to do his reasonable best to remedy the disturbance and to minimize any possible damage.

 

12 Liability of amii

 

amii is liable for damages resulting from injury to life, body, or health, as well as for other damages resulting from an intentional or grossly negligent breach of duty by amii or an intentional or negligent breach of typical contractual obligations by amii. A breach of duty by amii is equivalent to a breach of duty by a legal representative or vicarious agent. Further claims for damages are excluded unless otherwise agreed.

 

The liability of amii for loss or damage to property brought by guests is limited in accordance with §§ 701 et seq. of the German Civil Code (BGB).

Liability is limited to €3,500 for personal property and to €800 for cash, securities, and valuables, unless a separate written agreement for safekeeping has been made in advance.

amii accepts no liability for items left unattended in the cabin or accommodation. The guest is responsible for securing their valuables appropriately.

If a parking space is made available to the guest, even for a fee, this does not constitute a storage contract. amii is not obligated to monitor the parking space. In the event of loss or damage to motor vehicles or bicycles parked or maneuvered on the property, or their contents, amii is only liable in cases of intent or gross negligence. The guest is obligated to report any damage immediately, and in any case, to report obvious damage before leaving the parking facility. amii is not liable for damage that is solely the responsibility of other tenants or other third parties.

 

Messages, mail, and goods sent to guests are handled with care; however, amii assumes no liability for this. amii assumes responsibility for delivery, storage, and—upon request—forwarding of such items for a fee. Paragraph 1 above applies accordingly. This does not constitute a safekeeping contract.

 

amii assumes no liability for lost property. This excludes liability for intentional or grossly negligent breaches of duty by amii. Lost property will only be returned upon request and subject to a fee covering the corresponding postage costs (depending on the destination) and a processing fee of €10.00. The accommodation provider undertakes to store the property for a period of six months.

 

13 Final provisions & house rules

 

The contract language is German, and there is also a translation of the terms and conditions into English.

 

These terms and conditions also include compliance with our House rules (see chapter 6), which is also available in its currently valid version on our homepage.

 

Any changes or additions to the contract, the acceptance of the application, or these Terms and Conditions for the rental of rooms must be made in writing. Unilateral changes or additions by the guest are invalid.

 

The place of performance and payment is the registered office of the accommodation provider.

The exclusive place of jurisdiction – including for check and bill disputes – is the registered office of Alp Ami Hospitality GmbH, provided the guest is a merchant. If a contractual partner meets the requirements of Section 38, Paragraph 2 of the Code of Civil Procedure (ZPO) and does not have a general place of jurisdiction within Germany, the place of jurisdiction shall be the registered office of amii.

 

German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict of laws rules is excluded.

 

Should individual provisions of these General Terms and Conditions and/or the contract for the rental of rooms be or become invalid or void, the validity of the remaining provisions shall not be affected. In this case, the statutory provisions shall apply.
